UPDATED GUIDANCE FOR UK TIER 1, TIER 2, TIER 4 and TIER 5 VISA HOLDERS.
Firstly, Let’s talk about Tier4 Visa Applications.
If you have applied for a Tier 4 visa and are waiting for a conclusion on your Tier 4 Visa application. You can start your degree or course before your Tier 4 visa application has been decided only if:
Your sponsor is a registered Tier 4 sponsor.
The degree course you begin is similar to the one mentioned on your confirmation of acceptance for studies (CAS).
You have an authorised Academic Technology Approval Scheme (ATAS) certificate if obligated.
You have been provided a confirmation of acceptance for studies
You made a Tier 4 Visa Application before your current visa expired and you provided your sponsor evidence of this
If your Tier 4 visa application is ultimately refused as inacceptable or refused you should discontinue your course or studies.

Tier 2 and Tier 5 Visa Applications.
If you’ve applied for a Tier 2 or 5 visa and are waiting for a decision on your application
You can start work before your visa application has been decided if:
You have been allocated a Certificate of Sponsorship (CoS)
You made your visa application before your current visa expired and you demonstrated your sponsor evidence of the new visa application.
The job you commenced is the same as the one mentioned on your Certificate of Sponsorship (CoS).
If your visa application is sooner or later declined as void or rejected, your sponsor will end sponsoring you and you should discontinue working for them.
Tier 1 Entrepreneur visa Applications
If you are on a Tier 1 Entrepreneur visa and your business has been disturbed, the following are the new guidelines.
You no longer required to provide work for at least 2 people for 12 consecutive months each. The 12 month phase you are obligated to employ anyone, can be made up of numerous jobs amidst different months.
Furthermore, the Time period when your employees were granted leave of absence, will not be counted towards the 12 month period.
If you were unable to employ staff for 12 months overall by the time your visa expires, you will be permitted to provisionally extend your stay to provide you time to meet the obligations.
Please note that these measures will continue for visa applications made after 31 May 2020, where the vacancies you are depending on, were unsettled due to COVID-19.
